Dr. Nazir Muhammad Ayyad answered Mufti of the RepublicTo a question he received that read: What is the ruling on selling a falcon trained for hunting? A citizen from an Arab country obtained a license from the state to operate a farm to raise falcons, train them to hunt, and sell their products. He asked a friend of his to share a share in this activity, and this owner asked: Is it permissible according to Islamic law to sell falcons and take their price?
Ayyad said on the official website of the Egyptian Fatwa House that there is no legal objection to selling falcons and taking their price as long as they are trained to hunt and are used to benefit. Especially since it is valued money, and valued money is subject to sale according to Sharia law, provided that this is done in the manner authorized by the state, and in accordance with what is determined by the regulations and laws regulating this matter.
Ruling on dealing in buying and selling falcons prepared for hunting
His Eminence the Mufti continued: Buying and selling falcons prepared for hunting is permissible according to Islamic law. Because the noble Sharia has permitted the use of it, so it is valued money, and valued money is subject to sale according to Sharia law. He explained: Imam Ibn Abidin al-Hanafi said in “Rad al-Muhtar” (5/68, ed. Dar al-Fikr): [ويجوز بيع البَازِي والشاهين والصقر وأمثالها] Oh, and Imam Ibn Abi Zaid Al-Qayrawani Al-Maliki said in “Al-Nawadir wal-Ziyadat” (3/209, Dar Al-Gharb Al-Islami Edition) when talking about spoils: [وأما الصقور والبزاة وما يُصادُ به مما يَعظُمُ قَدْرُه فَلْيُرَدَّ في المَقَاسِمِ، ولا يكون لمن صادَهُ أن يَخرُج به، وإن باعَهُ رَدَّ الثمن في المَغْنَم] Oh. He stated that falcons are valuable, and that their sale is permissible according to Islamic law.
