New York announced the abolition of the marital infidelity law, which requires a 3-month prison sentence, according to the Associated Press.
Abolition of the marital infidelity law
According to the report, the aforementioned law, which is rarely used and is more than a century old, considers marital infidelity a misdemeanor that may lead to imprisonment for three months.
For her part, Governor Kathy Hochul signed a bill repealing the law, which dates back to 1907 and has long been considered outdated and difficult to implement.
She said: While I have been fortunate to share a loving married life with my husband for 40 years, which makes it somewhat ironic for me to sign a bill decriminalizing infidelity, I know that people often have complicated relationships.
She added: “Clearly these are matters that should be dealt with by these individuals and not our criminal justice system.”
Let’s get this ridiculous, outdated law off the books, once and for all.
It is noteworthy that the infidelity ban is actually a law in many states and was enacted to make obtaining a divorce more difficult at a time when proving a spouse cheated was the only way to obtain a legal separation.
The state law was used for the first time a few weeks after it took effect, according to a New York Times article, to arrest a married man and a 25-year-old woman.
